Terms of Service

INTRODUCTION

These Terms and Conditions ("Terms") govern the provision of website design and development services by [Your Business Name] ("Designer", "we", "us", or "our") to you ("Client", "you", or "your"). By engaging our services, you agree to be bound by these Terms.

Services Provided

We specialise in bespoke website design and development using Figma for design and Framer for implementation. The scope of work will be outlined in a separate project proposal or agreement.

PAYMENT TERMS

A 50% non-refundable deposit is required before work commences.

  • The remaining 50% is due upon project completion, before final files are handed over.

  • Payments must be made via bank transfer.

  • Late payments may incur additional charges.

Project Scope and Revisions

  • The project scope will be outlined in the agreement.

  • Revisions beyond the agreed scope may incur additional charges.

  • Any major alterations requested after project approval will be subject to a separate fee.

Kill Fees and Cancellation

  • If the Client terminates the project after work has commenced, a "kill fee" will be charged based on the work completed up to the point of cancellation.

  • The kill fee will be determined at our discretion but will not exceed the full project cost.

  • The initial deposit is non-refundable under any circumstances.

Delivery and Handover

  • The final Framer website files will only be transferred once full payment has been received.

  • We are not responsible for any issues arising after handover unless covered by a separate maintenance agreement.

Intellectual Property

  • We retain ownership of all design files and source materials until full payment is received.

  • Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the final website design.

  • We reserve the right to publish the completed website in our portfolio and promotional materials unless the Client explicitly requests otherwise in writing.

Client Responsibilities

  • The Client must provide all necessary content, images, and branding materials before the project commences.

  • Delays in providing required materials may result in timeline extensions and potential additional fees.

Liability and Warranty

  • We will take reasonable care in designing and developing your website, but we do not guarantee that it will be free from errors or compatible with all devices.

  • We are not liable for any loss of business, revenue, or data arising from the use of the website.

Amendments to Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of any revised Terms.

Governing Law
